These Terms of Service ("Terms") govern your access to and use of koriecull.com and store.koriecull.com, including all content, features, and services offered on or through them (collectively, the "Site"), operated by Korie Cull ("Korie Cull," "we," "us," or "our"). By accessing or using the Site, placing an order, or creating an account, you ("you" or "User") agree to be bound by these Terms. If you do not agree, please do not use the Site.


1. Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Site or place an order. By using the Site, you represent that you meet this requirement.


2. Intellectual Property

The Site and all content on it — including artwork, photographs, product designs, text, graphics, logos, animations, and the overall look and feel (collectively, "Content") — is owned by or licensed to Korie Cull and is protected by U.S. and international copyright, trademark, and other intellectual property laws. Your use of the Site does not grant you any ownership or license rights in the Content.

You agree not to:

  • Copy, scrape, mine, or reverse engineer any part of the Site, by manual or automated means, including for the purpose of training any artificial intelligence or machine learning model;
  • Modify, adapt, translate, reformat, create derivative works from, decompile, disassemble, or otherwise alter any part of the Site, or assist others in doing so;
  • Reproduce, distribute, publicly display, license, sublicense, rent, sell, or otherwise commercialize any Content without prior written consent; or
  • Remove, obscure, or alter any copyright, trademark, or other proprietary notices on the Site.

Purchasing a physical product does not transfer any copyright or reproduction rights in the underlying artwork; all such rights remain with Korie Cull unless otherwise agreed in writing.


3. Products, Orders, and Pricing

  • Product accuracy. We make reasonable efforts to display product colors, materials, and dimensions accurately. Minor variations may occur due to the handmade nature of the work, screen display settings, and production batch differences.
  • Limited availability. Many items are produced in limited runs or as one-off originals. Listings may be modified, limited, or removed at any time prior to order confirmation.
  • Pricing. All prices are listed in USD and are subject to change without notice; the price charged will be the price displayed at the time your order is placed. In the event of a pricing or listing error, we reserve the right to cancel the order and issue a full refund.
  • Order acceptance. Receipt of an order confirmation does not guarantee acceptance of your order. We reserve the right to limit, refuse, or cancel any order at our discretion, including in cases of suspected fraud or error.
  • Shipping, returns, and cancellations are governed by our [Return and Shipping Policy](#), which is incorporated into these Terms by reference.


4. Payment

Payment is processed through the Site's third-party payment processor(s) at the time of order. We do not store your full payment card information. You represent that any payment information you provide is accurate and that you are authorized to use the payment method submitted.


5. User Conduct

You agree not to use the Site to:

  • Violate any applicable local, state, national, or international law;
  • Infringe the intellectual property, privacy, or other rights of any party;
  • Transmit any harmful code, malware, or unsolicited advertising;
  • Attempt to gain unauthorized access to the Site, other user accounts, or connected systems; or
  • Use any automated means (bots, scrapers, crawlers) to access or interact with the Site without prior written permission.


6. Third-Party Links and Services

The Site may link to or integrate with third-party websites, platforms, or services (including payment processors and social media platforms) that are not owned or controlled by Korie Cull. We are not responsible for the content, terms, or privacy practices of any third party, and inclusion of a link does not imply endorsement.


7. Copyright Infringement Notification (DMCA)

If you believe any Content on the Site infringes your copyright, please send a written notice to shop@koriecull.com that includes: (a) a description of the copyrighted work claimed to be infringed; (b) the location of the material on the Site; (c) your contact information; (d) a statement of good-faith belief that the use is unauthorized; and (e) a statement, under penalty of perjury, that the notice is accurate and that you are authorized to act on behalf of the copyright owner.


8. Disclaimer of Warranties

The Site and all Content and products are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site will be uninterrupted, timely, secure, or error-free.


9. Limitation of Liability

To the fullest extent permitted by law, Korie Cull shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site or any product purchased through it, regardless of the legal theory asserted, even if advised of the possibility of such damages. Korie Cull's total aggregate liability arising from these Terms or your use of the Site shall not exceed the amount you paid for the product or order giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.


10. Indemnification

You agree to indemnify, defend, and hold harmless Korie Cull from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of a third party.


11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.

Any dispute arising out of or relating to these Terms or your use of the Site shall first be attempted to be resolved informally by contacting shop@koriecull.com. If a dispute cannot be resolved informally within 30 days, it shall be subject to the exclusive jurisdiction of the state and federal courts located in California, and each party consents to personal jurisdiction and venue there.


12. Force Majeure

Korie Cull is not liable for any delay or failure to perform resulting from causes outside reasonable control, including natural disasters, acts of government, labor disputes, carrier delays, or other events of force majeure.


13. Severability and Waiver

If any provision of these Terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.


14. Entire Agreement

These Terms, together with the Return and Shipping Policy and any other legal notices published on the Site, constitute the entire agreement between you and Korie Cull regarding the Site and supersede any prior agreements.


15. Changes to These Terms

We may revise these Terms at any time by posting an updated version on this page with a new "Last updated" date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.


16. California Consumer Notice
